Terms of Service

These Terms of Service (“Terms”) govern your use of the A Moment With app and website (the “Service”), provided by A Moment With Pty Ltd (ABN 16650349203), Melbourne, Australia (“A Moment With”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 16 years old (or the minimum age of digital consent where you live) to create an account. If you are under that age, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms. You are responsible for keeping your login details secure and for activity on your account.

2. Your account

You agree to provide accurate information and to keep it up to date. Tell us promptly at support@amomentwith.com if you believe your account has been compromised. You may close your account at any time from within the app (Profile → Delete Account).

3. Subscriptions and billing

  • A Moment With offers a free tier and paid subscription plans (Premium and Legacy+). Plan features and prices are shown in the app before you purchase.
  • In-app purchases are billed through your Apple App Store account. Payment is charged at confirmation of purchase. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
  • You manage or cancel a subscription in your device’s Settings → Apple ID → Subscriptions. Deleting the app does not cancel a subscription.
  • Introductory or promotional offers (including offer codes) apply only as described at the time and to eligible accounts, and revert to the standard price afterwards.
  • Refunds for App Store purchases are handled by Apple under its policies. Purchases made on our website are processed by Stripe.
  • We may change plans or prices; we will give reasonable notice, and changes will not affect the period you have already paid for.

4. Your content

The photos, videos, voice notes, and writing you add (“Your Content”) belong to you. We do not claim ownership of Your Content.

To run the Service, you grant us a limited, non-exclusive licence to host, store, back up, process, and display Your Content solely to provide the Service to you and the people you choose to share with — including generating thumbnails and previews and, where you ask for it, AI-assisted features. This licence ends when you delete Your Content or your account, except for backup copies retained briefly as described in our Privacy Policy, and except where others you shared with still hold their own copies.

We do not sell Your Content, and we do not use it to train AI models. You are responsible for Your Content and for having the rights to share it.

5. AI-assisted features

A Moment With uses AI to assist — to help curate, organise, score, and draft — never to fabricate your memories. AI suggestions are provided to help you and may not always be accurate; you remain in control and can edit or remove anything before it is saved or shared.

6. Acceptable use

You agree not to:

  • upload content that is unlawful, infringing, harmful, or that you do not have the right to share;
  • upload another person’s private images or information without their consent;
  • harass, abuse, or harm others, or misuse sharing or invitation features;
  • attempt to access accounts or data that are not yours, or probe, scan, or disrupt the Service;
  • copy, reverse-engineer, or resell the Service except as permitted by law.

We may remove content or limit accounts that breach these Terms.

7. Sharing and privacy

You control who can see each Story and Moment (Private, People, or Public). When you invite people or make content Public, you are responsible for what you choose to share. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

8. Intellectual property

The Service itself — including the A Moment With name, logo, software, and design — belongs to A Moment With Pty Ltd and is protected by law. These Terms do not give you any right to use our branding without our written permission.

9. Third-party services

The Service relies on third parties (including Apple, Amazon Web Services, Google Firebase, RevenueCat, Stripe, and Gelato). Your use of those services may also be subject to their own terms. We are not responsible for third-party services we do not control.

10. Disclaimers

The Service is provided “as is” and “as available”. While we take care to keep your memories safe and the Service reliable, we do not warrant that it will be uninterrupted, error-free, or that data will never be lost. Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

11. Limitation of liability

To the extent permitted by law, A Moment With is not liable for indirect, incidental, or consequential loss, and our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Where the Australian Consumer Law implies guarantees that cannot be excluded, our liability is limited (where permitted) to re-supplying the Service or paying the cost of re-supply.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you materially breach these Terms or use the Service in a way that risks harm to others or to the Service. On termination, your licence to use the Service ends; deletion of Your Content follows our Privacy Policy.

13. Apple App Store terms

If you download the app from the Apple App Store, the following also apply:

  • These Terms are between you and A Moment With only, not Apple. Apple is not responsible for the app or its content.
  • Your licence to use the app is limited to Apple-branded devices you own or control, under the App Store Usage Rules.
  • A Moment With (not Apple) is solely responsible for the app, its support and maintenance, and any product claims, including liability, legal, or intellectual-property claims. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
  • You confirm you are not located in a country subject to a US Government embargo and are not on any US Government prohibited-parties list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

14. Changes to these Terms

We may update these Terms from time to time. Changes will be posted here with a new “Last updated” date, and material changes will be notified by email or in-app notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria.
